These Terms of Service ("Terms") form a legally binding agreement between you ("you", "user", "subscriber") and the operator of MyKharch ("MyKharch", "we", "us"). By creating an account or using the Service, you accept these Terms and our Privacy Policy. If you do not accept them, do not use the Service.
This document is published as an electronic record under the Information Technology Act, 2000 and the rules thereunder. It does not require any physical or digital signature.
1. Service description
MyKharch is a software-as-a-service personal accounting product for individuals and small businesses in India. It allows you to record income, expenses, receivables, payables and journal entries; generate GST-compliant invoices and reports; and maintain a double-entry ledger.
2. Eligibility
You must be at least 18 years old and competent to enter into a contract under the Indian Contract Act, 1872. By registering, you confirm that the information you provide is accurate and that you have the authority to bind your business if you sign up on its behalf.
3. Account, security and acceptable use
- You are responsible for maintaining the confidentiality of your credentials and all activity under your account.
- You agree not to misuse the Service — including reverse-engineering, attempting to bypass authentication, sending spam or malware, or using it to commit fraud or money-laundering.
- You must comply with all applicable Indian laws, including the Income Tax Act 1961, the GST Acts, and the IT Act 2000.
4. Subscription, billing and taxes
We offer a 30-day free trial. After the trial, continued use requires a paid subscription. Subscription fees are billed in advance in Indian Rupees (INR) and are exclusive of applicable GST, which is added at checkout. You authorise us to charge your selected payment method through Cashfree, PhonePe or any other RBI-licensed gateway we use.
We may change pricing with at least 30 days' notice; price changes do not affect the current billing cycle. Cancelling stops future renewals; access continues until the end of the paid period.
5. Refunds and cancellation
Refunds and cancellations are governed by our Refund & Cancellation Policy, which forms part of these Terms.
6. Your data and ownership
You own your data. We act as a "Data Fiduciary" under the Digital Personal Data Protection Act, 2023 in respect of personal data, and as a custodian of your business records. We do not sell your data, and we do not use it to train third-party machine-learning models. You may export your data at any time from Settings → Security → Download your data.
7. Service availability
We aim for 99.5% monthly uptime measured at the public endpoint, excluding scheduled maintenance windows announced in advance. The Service is provided on an "as is" basis without any warranty of fitness for a particular purpose.
8. Limitation of liability
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service shall not exceed the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill.
9. Intellectual property
The MyKharch product, brand, code, design and documentation are our intellectual property. You receive a non-exclusive, non-transferable licence to use the Service for the duration of your subscription.
10. Termination
You may close your account at any time from Settings → Security → Delete account. We may suspend or terminate access if you breach these Terms or applicable law, with notice where reasonable. After termination, financial records retained under the Income Tax Act and the IT Act 2000 (eight-year retention) are pseudonymised but not destroyed.
11. Changes to these Terms
We may update these Terms when our product, pricing or applicable law changes. Material changes will be notified by email and on the dashboard at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
12. Governing law and disputes
These Terms are governed by the laws of India. Disputes will be resolved by the courts of Ahmedabad, Gujarat, India, except where applicable consumer protection law gives you the right to your local courts.
